GENERAL TERMS AND CONDITIONS OF SALE - SYGLAM


I. IDENTITY OF THE SELLER

All orders placed on the Site are subject to these terms and conditions of sale. These terms and conditions may be modified and updated; the terms and conditions applicable to a customer's order are those in effect on the date the order is placed. These terms and conditions of sale are governed by French law, except where otherwise required by mandatory provisions such as those arising from the Rome Convention on the Law Applicable to Contractual Obligations of 19 June 1980.


II. PURPOSE

These general terms and conditions of sale (hereinafter the "General Terms and Conditions of Sale") govern exclusively the sales made on the website syglam.com (hereinafter the "Site") of products offered by SyGlam to buyers who are consumers (hereinafter the "Customer(s)") and specify the conditions of ordering, payment, delivery and handling of any returns of products ordered by Customers.

The General Terms and Conditions of Sale are made available to Customers on the syglam.com website where they can be consulted directly.

The General Terms and Conditions of Sale are binding on the Customer who declares to have read and accepted them by ticking the box "I accept the General Terms and Conditions of Sale" before implementing the online ordering procedure.

SyGlam reserves the right to modify its General Terms and Conditions of Sale at any time. In the event of a modification to the General Terms and Conditions of Sale, the applicable General Terms and Conditions of Sale are those in effect on the date the order is validated. It is therefore the Customer's responsibility to refer to them each time an order is validated.

The invalidity of a contractual clause does not render the General Terms and Conditions of Sale invalid.

The temporary or permanent non-application of one or more clauses of the General Terms and Conditions of Sale by SyGlam shall not constitute a waiver by SyGlam of the application of that or those clauses or of the other clauses of the General Terms and Conditions of Sale which shall continue to produce their effects.


III. THE CLIENT

The Site's customer must be a consumer, a natural person of legal age and capacity. Upon placing their first order on the Site, the customer must create a customer account and complete an order form specifying certain mandatory fields in order for their product order to be processed by SyGlam.

The information provided to SyGlam when opening a customer account or placing an order must be complete, accurate, and up-to-date. SyGlam may, if necessary, request confirmation of this information and the customer's identity by any means.

Given the commercial policy described above, SyGlam reserves the right not to process orders from subjects other than the "Consumer" or orders that do not comply with its commercial policy.


IV. PRODUCTS

The essential characteristics of the products are presented on syglam.com within each product description. However, the images and colors of the products offered for sale on syglam.com may not correspond to the actual colors due to differences in internet browsers and screen displays.

All our rings are adjustable and fit standard finger sizes (size 50-58). No resizing is necessary.


V. PLACING AN ORDER

The steps

Placing an order on the Site is subject to compliance with the procedure put in place by SyGlam, which is embodied by a succession of different screen pages indicating the steps that the customer must absolutely follow to validate their order.

Before definitively validating their order, the customer will have the opportunity to check its details and total price, and to correct any errors, before confirming it to express their acceptance.

Order verification

SyGlam will also be entitled to refuse any order placed by a customer with whom there is a dispute relating to the payment of a previous order, as well as any order that does not comply with these general terms and conditions of sale.

In such cases, SyGlam will inform the customer by telephone or email. If the customer fails to correct any errors or discrepancies with these terms and conditions of sale, SyGlam reserves the right to refuse to process the order.

Procedure

Start by making your selection by browsing the site or using our search method.

Click on the images to access the product pages and view the details of each ring. Add the items to your cart by clicking "Add to cart".

Then check the nature of the items added to your cart.

To delete an item, click on "Delete" and to change the number of items, modify the quantity and click on "Refresh".

You can then finalize your order or choose to continue shopping.

To conclude the purchase contract for one or more products on syglam.com, you must fill out the order form provided by the site by following the instructions.

The order form contains a summary of the General Terms and Conditions of Sale, as well as information on the essential characteristics of each of the products ordered and the price which refers to it (including applicable taxes or duties), the means of payment which you can use to purchase each product and the terms of delivery of the products purchased, the shipping and delivery costs, the conditions for exercising your right of return, and finally, the terms and conditions for returning the products purchased.

The contract is concluded when SyGlam receives your order form electronically and once the accuracy of the order data has been verified.

Before proceeding with the purchase of products by submitting the order form, you will be asked to carefully read the General Terms and Conditions of Sale.

The order form will be archived in SyGlam's database for the time necessary to ship orders and in accordance with legal requirements. You can access your order form by going to "My Account / My Orders".

Before submitting the order form, you will also be asked to detect and correct any data entry errors.

Once the contract is concluded, SyGlam will take charge of your order.

If the products displayed on syglam.com are no longer available or for sale at the time of your last visit to the site or when you submit the order form, SyGlam must promptly inform you, and in any case, within thirty business days from the day after you placed your order, of the unavailability of the ordered products. If you have already submitted the order form and paid the price, SyGlam will take the necessary steps to refund the amount you have paid.

By submitting the order form electronically, you agree to the General Terms and Conditions of Sale and undertake to comply with these terms in your dealings with SyGlam. If you disagree with any of the terms stated in the General Terms and Conditions of Sale, please do not submit your order form for the purchase of products on syglam.com.

Order modification or cancellation

Orders are not subject to change due to their immediate execution and for technical reasons.

In the event of a website malfunction affecting orders or transactions, or a stock shortage of ordered products, SyGlam reserves the right to cancel online orders placed by customers. Customers will be notified by email or telephone to explain the reason for the order cancellation.


VI. PRICE AND PAYMENT TERMS

The prices displayed on the website are in Euros.

The prices displayed on the Site are inclusive of all taxes (VAT), excluding delivery charges. The prices charged to the customer are those in effect on the date of the order.

Payment can be made by credit card, bank transfer or PayPal.

The customer accesses a dedicated space provided by a banking institution, which ensures the security and recording of the payment order.


VII. DELIVERY

The customer is solely responsible for any delivery failure due to a lack of information when placing the order.

It is the Client's responsibility to check the external appearance of the packaging and to note any visible damage to the packaging on the delivery slip.

Delivery times

Delivery times are 5 to 7 working days for mainland France.

Please note that any change of delivery address made by the Customer after the order has been placed may result in a longer delivery time. SyGlam cannot be held liable for lost packages if the address provided during the ordering process is incorrect.

Since carriers are separate and independent entities, SyGlam cannot be held responsible for any delivery delays attributable to the carrier in question.

Delivery costs

Free tracked delivery on orders of 2 rings or more.
For an order of 1 ring: delivery charges of [AMOUNT] euros.


VIII. RIGHT OF WITHDRAWAL AND RETURN PROCEDURES

The customer has a right of withdrawal which he may exercise, without having to justify reasons, within fourteen (14) clear days from the receipt of the products ordered.

When the fourteen (14) day period expires on a Saturday, Sunday or public holiday, it is extended until the next working day.

However, we draw your attention to the fact that a refund for the rings can only be issued if all of the following conditions are met:

  • The product must not have been worn (except for reasonable trying), used, excessively altered, damaged, or subjected to any manipulation that could prevent its resale in its original condition.
  • The product must be returned in its original packaging and case.
  • All included accessories must be returned (pouch, certificate if applicable)

Our rings are adjustable, so no resizing is necessary. However, if the customer has made an excessive adjustment that has irreversibly deformed the product, SyGlam reserves the right to refuse the return or apply a deduction.

To simplify the exercise of the right of withdrawal, SyGlam asks customers to notify them by any means. At this time, the customer can specify whether they want a refund or a credit note.

The customer will also have the option to contact customer service by email at hello@syglam.com for any further information.

Shipping costs for returning products remain the responsibility of the customer unless the product received is not as described or has a manufacturing defect.

SyGlam strongly advises its customers to return products via Colissimo with signature confirmation. Customers also have the option of choosing their preferred carrier. However, return shipping costs and any associated risks are the customer's responsibility. Therefore, it is recommended that customers retain proof of return, which means returning products with package tracking or by any other method that provides a verifiable date.

The right of withdrawal, in addition to compliance with the deadlines and procedures described in the preceding points, is considered to be correctly exercised if the following conditions are fully met:

  • We invite you to notify us of your return request by email or telephone.
  • The product must not have been worn (except for reasonable fitting), used, excessively altered, or damaged.
  • Returned products must be sent to SyGlam in a single shipment. SyGlam reserves the right to refuse items from the same order that are returned and shipped at different times.

In addition to the amount paid for the products, SyGlam will refund the shipping costs for the delivery of the purchased products only if the return is due to a reason attributable to SyGlam, for example, if the products do not possess the essential characteristics promised, have manufacturing defects, or if there are errors in their delivery. In the latter case, you can inform us by email or telephone.

If the terms and conditions for exercising your right of withdrawal have not been met, as outlined above, you will not be entitled to a refund of any sums already paid to SyGlam. However, you may retrieve your products at your own expense, in the condition in which they were returned to SyGlam. Otherwise, SyGlam may retain the products, in addition to the sums already paid for their purchase.


IX. REFUND TERMS AND CONDITIONS

If the right of withdrawal is exercised in accordance with the terms and conditions indicated above, SyGlam will take the necessary steps to reimburse any sums already collected for the purchase of the products within fourteen (14) days after receipt and verification of the condition of the products.

In the event that there is no match between the recipient of the products indicated in the order form and the one who made the payment of the sums due for the purchase, the refund of the sum, in the event of exercising the right of withdrawal, will be made by SyGlam, in all cases, to the one who made the payment.

The refund will be made to the same medium used when purchasing the products, i.e. the bank card of the person who made the payment.

SyGlam accepts returns after 14 days, with a deduction applied to the refund amount or in the form of a store credit. Please contact us at hello@syglam.com to learn about the return policy for your jewelry.


X. LEGAL GUARANTEES

Regardless of any commercial warranty that may be granted by SyGlam to the Customer, all products supplied by SyGlam benefit from the legal guarantee of conformity provided for in Articles L. 211-4 to L. 211-13 of the Consumer Code.

It protects the buyer for 6 months against defects in conformity existing at the time of sale. This means that the goods must:

  • correspond to the description given by the seller
  • to be functional for its intended use (to be worn as an anti-stress jewel with a rotating mechanism)
  • and possess the advertised qualities, particularly in terms of material (316L stainless steel, 18K gold plating, crystals)

It does not protect the buyer against damage occurring after the purchase of the jewelry: ring damaged by excessive handling, improper fitting, etc. These repairs can, where possible, be carried out by SyGlam's after-sales service at the customer's expense.

If these points are respected, SyGlam undertakes, at the Client's choice, to refund or exchange the jewelry that does not correspond to their order.

To benefit from the guarantee, the Customer must contact SyGlam Customer Service by following these steps:

  • Please have your order number and the reference number of the item in question ready (this information is indicated on your purchase invoice).
  • Submit your support request to SyGlam Customer Service by email at the following address: hello@syglam.com
  • To ensure prompt and efficient processing of the warranty claim, the Customer must provide their contact information, order number, and the reference number of the item in question, and describe the problem in as much detail as possible. If possible, the Customer should also attach a photograph of the product defect to the email.

XI. INTELLECTUAL PROPERTY

The Client acknowledges that SyGlam Products and distinctive signs (image, photographs, packaging, product name, etc.) are the exclusive property of SyGlam.

The Client shall refrain from any act of reproduction or use of product models, packaging, trademarks or distinctive signs, inventions, techniques or know-how used by SyGlam, as well as any act tending to the appropriation of these elements, whether or not they are subject to protection by SyGlam by a patent, trademark, registered design or copyright.


XII. INFORMATION TECHNOLOGY AND FREEDOM OF INFORMATION TECHNOLOGY

The Client is informed that the data he provides on the Website is subject to various automated processing of personal data.

In accordance with French Law No. 78-17 of 6 January 1978 on Information Technology, Data Files and Civil Liberties, and the General Data Protection Regulation (GDPR), please note that the personal data collected from the Customer is necessary for processing their order. It may also be used for marketing purposes. The purposes of each data processing activity are described alongside the relevant processing activity.

This data is intended for internal use by SyGlam. This personal data may also be transmitted to third parties, partners of SyGlam, unless the Client has objected to this during the collection of their data.

The Client's personal data is kept for the period strictly necessary to fulfill the purposes for each of the processing operations envisaged by SyGlam.

In accordance with the law of 6 January 1978 and the GDPR, the customer has the right to access, rectify, delete and object to personal information and data concerning him/her by contacting customer service by email at hello@syglam.com.

In accordance with the application of article L.223-2 of the Consumer Code, the customer has the right to register on the list of those who object to telephone solicitation.


XIII. RESPONSIBILITY

SyGlam cannot be held liable for non-performance or improper performance of the contract due to the Client's actions, an unforeseeable and insurmountable event caused by a third party to the contract, or a case of force majeure.


XIV. DISPUTE RESOLUTION AND APPLICABLE LAW

Sales concluded with SyGlam via the website syglam.com are governed by French law. In the event of a dispute, an amicable solution will be sought before any legal action is taken. Failing that, all disputes arising from this contract, concerning its validity, interpretation, performance, termination, and their consequences, will be submitted to the competent court in accordance with the rules of jurisdiction under common law.
